Atmos Terms of Use
Acceptance and scope

These Terms govern access to and use of Atmos, Sercle’s browser-based digital-home experience. By using Atmos, you agree to these Terms. If you do not agree, do not use Atmos.

Current capability boundary

The current Atmos Web release is a static Flutter Web application delivered through Vercel. It provides a browser-local resident experience. It does not provide a production Sercle account backend, cloud authentication, cloud backup or synchronization, paid subscriptions, purchases, paid features, production application APIs, or audio playback.

A locally created resident is product state, not a cloud account. Interface references to residents, identity, ambience, synchronization, accounts, or future services do not promise that an external service exists.

Permitted use

You may use Atmos for lawful personal, household, educational, evaluation, and other permitted purposes. You must not interfere with its operation or security, attempt unauthorized access, introduce malicious code, unreasonably burden the service through automation, violate applicable law, or infringe the rights of others.

Do not place another person’s sensitive information in local resident fields without authority.

Local state and persistence

Atmos stores resident and product state in browser storage, including IndexedDB atmos-v1 and limited local snapshot or preference state.

State may be lost if browser data is cleared, browsers or devices change, private or storage-restricted modes are used, a profile is reset, or software behavior changes. Sercle does not guarantee preservation, recovery, synchronization, backup, portability, or migration.

If durable storage is unavailable, Atmos may refuse to save and may not provide a designed message for every failure condition. You are responsible for keeping any separate record you need.

Availability and changes

Atmos is provided “as is” and “as available” to the extent permitted by law. Sercle may maintain, modify, suspend, restrict, or discontinue features or access.

Sercle does not promise uninterrupted or error-free operation, any service level, permanent availability of local state, or compatibility with every browser, device, accessibility configuration, or storage mode.

Hosting and third-party components

Atmos uses Vercel hosting, so delivery, availability, security controls, and operational request processing depend partly on that provider.

Atmos is built with Flutter Web, CanvasKit, and other open-source software and may include third-party fonts, libraries, notices, or components. Those materials remain subject to applicable licenses, attribution requirements, provider terms, and rights. Sercle does not guarantee their continued availability or behavior.

No professional or emergency service

Atmos is not legal, medical, financial, safety, emergency, or other regulated professional advice or service. Do not rely on Atmos to contact emergency services, preserve emergency information, or support decisions requiring authoritative guidance.

Intellectual property

Atmos, Sercle and Atmos branding, original interfaces, text, designs, software, and other Sercle-provided materials are owned by or licensed to Sercle and protected by applicable law. Third-party materials remain governed by their licenses and rights.

These Terms grant only a limited, revocable, non-exclusive right to use Atmos in accordance with these Terms, applicable law, and applicable licenses.

Disclaimers and limitation

To the extent permitted by law, Sercle disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, data preservation, and uninterrupted operation not expressly stated here. Nothing excludes a right that cannot lawfully be excluded.

You are responsible for your use of Atmos, control of your browser profile and device, and copies of information you need.

To the extent permitted by law, Sercle is not responsible for indirect, incidental, special, consequential, or exemplary loss arising from use or inability to use Atmos, loss or corruption of local state, storage restrictions, device or browser changes, or interruption or change of hosting or third-party components. This limitation does not apply where prohibited by law.

Termination and changes

You may stop using Atmos at any time and remove local state through available Atmos or browser controls. Sercle may restrict access to protect the service, users, third parties, legal compliance, or security, or after a material violation.

Sercle may update these Terms prospectively for product, provider, legal, or operational changes. Production accounts, cloud synchronization, paid services, backend processing, analytics, telemetry, or audio processing require renewed factual and legal review rather than reliance on this draft.
